Health Guarantee as follows:
Seller guarantees that as of the date of this agreement puppy is in good health and at the time the puppy was
placed on the transport (if shipped) puppy has received appropriate dewormings and is up to date
on vaccinations. Seller will provide Buyer with a medical chart detailing the treatments the puppy has received under the
Seller's care.
Seller guarantees this puppy untill one year of age (from the puppy's
date of birth) against major life threatening gentic defects that would cause death. Seller will not be reasonsible
for illness or health problems that are diagnosed after this time period. If puppy's diagnosed with a major
life threatening
genetic defect during this time frame by a licensed veterinarian. The diagnosis must be supported
by a signed and sworn statement by the licensed veterinarian. You must contact Seller within 24 hours of diagnose
and return the puppy with all medical records, laboratory test, AKC forms, papers to Seller
within 2
bussiness days. Seller retains the option to a second opinion by a licensed veterinarian. If a puppy is
euthanized prior to the Seller having the option to get a second opinion, this guarantee will be void. Seller will have
the option to get a second opinion by a licensed veterianarian to confirm the defect. If the defect is confirmed,
the Seller will replace the puppy with another of equal value, when one becomes available. If one is not available
or will not be coming available of equal value, the buyer will be responsible for price differences due
to bloodlines, markings,etc.
In the unlikely event of this puppy's death in the first 12 months, due to
a life threatening gentic defect, a necropsy from a state veterniary lab, confirming such an event and cause is required before
the Seller will take any action. In addition, a photo of the deceased puppy must be sent with the necropsy report for I.D.
verification.
All cost of the above procedures and shipping (returning the puppy back to me) incurred by Buyer
are the Buyer's responsibility. The costs of the second opinions are the responsibility of the Seller.
A deposit is Nonrefundable nor can it be transfered to another puppy. However, if something happens to the puppy
while in my care and can not be sold, you will have a choice of the next available puppy or a puppy from a upcoming
litter.
A replacement puppy cannot be exchanged for a Cash refund.
Seller "Does
Not" guarantee against the following:
Adult size, height, color, coat or conformation we
can only try to predict these in a puppy.
Bites- No guarantee on a puppies Bite
after the puppy has left my home (bite can go off at teething but usually corrects),
Molera (open Fontnal)-
(have or not some puppies have Molera and others do not and should not be considered a flaw). Have never had
any health problems related to a open fontnal.
Hydrocephalus- No guarantee after a puppy has left my home this (can happen due to a fall,
or any type of trauma to the head). If this was to happen it can usually be controlled with medications.
Ears up or testicles dropped, (can take 8 months to drop in toy breeds),
Patella
Luxations-knees-parents have been examined
for PL all are clear. (No guarantee for Patella Luxation
after a puppy has left my home. This can happen due to a injury, a puppy running
and jumping alot, are jumping from your arms, jumping off a couch, chair, bed, steps, & ect). Sometimes
the Patella's may be loose on a puppy but will tighten up as the puppy grows.
Hernias, Worms
or Parasites- of any kind (even though our pups are dewormed very well before leaving our home).
Hypoglycemia- under no condition is the breeder responsible for the loss or death due to hypoglycemia (when
blood sugar drops low)
Calcium Drops- Breeder not responsible for drops in calcium.
Seizures/Epilepsy- Even
though our puppies show NO signs and have been vet checked. Breeder is not responsible,
seizures/epilepsy are not life
threating if treated. Can be caused from many things such as hypoglycemia, low calcium, trauma, toxin such as eating chocolate, and
so on...
Coccidia- Many puppies are prone to a outbreak of
coccidia under stressful circumstances. Sometimes 1-2 weeks later after a puppy has gone to its new home, and can not always
be prevented by the breeder, because their are no signs until the puppy becomes stressed, and their immune system drops. All
precautions have been made, but the buyer should take the puppy to the vet immediately if puppy develops runny blood in the
stool, vomiting or has loss of appetite.
Breeder does not remove dew claws for humain reasons.
Temperament, Disposition
or Conformation- in any puppy.
Whether or not this puppy can be Shown or has the Ability
to Breed or Free Whelp.
_______ At this time this puppy has been evaluated to be a show/breeding prospect,
and is being sold with full AKC, does not mean in anyway to guarantee you a show or breeding dog, but a puppy that,
at time of sale, appeares to have show/breeding potential.
My dogs do not have skin problems or allergies.
I do not guarantee against allergies or skin problems or runny eyes. (Allergies can be caused by, dogfood, your type
of grass, soaps, home carpet, cedar and pine chips, climate control, bug killers on your lawn or in your home, etc.)
Breeder is not responsible for any vet bills that accur after puppy or dog has left my home and gone to yours.
The Seller does not guarantee the puppy against injuries, illnesses or temperament caused
by the neglect or abuse of the Buyer. Seller has the right to refuse replacement of any puppy/dog for temperament or problems
caused by Buyer's neglect or abuse.
No refunds on owner allergies, incompatibilties, disputes, "changing
your mind for what ever reason" or disagreement among household members concerning the puppy. Please contact us
if you are unable to keep the puppy, we will take the puppy back and find a home for it. But NO REFUND will
be given. Buyer will be responable for all cost of shipping or returning (driving) the puppy back to seller.
Are we will try to help you find a new home for them if the need arises. We do not want to see one of our babies in an animal
shelter.
Buyer guarantees that he/she will not knowingly offer this puppy or any of it's offspring to puppy
brokers, puppymills or pet shops. If buyer is found to be selling the dog, or puppies in such a way, buyer will
incurr 1,200 penality for each puppy found to be sold in this way.
If purchasing a puppy as "PET" only. You will be required to have your puppy
spayed/neutered by 6-7 months of age before the orginal AKC registration papers are mailed to you. The AKC papers
on the dog or puppy will be withheld until notification of altering of animal is received and verified. If
you do not spay/neuter your pet this contract will be voided. Proof of the spay/neuter
must be received by the (buyer name) from your veterinarian that the puppy has been spayed or neutered and I will then
mail you your orginal AKC papers. This is ONLY to protect
my dogs and bloodlines from getting into the hands of backyard breeders and puppymills. I know breeding sounds
so easy but its not, breeding with out experience can mean losing a mom, puppies or both due to complications,
alot of things can go wrong when a female become pregnant, spaying and neutering helps to prevent any of this from happening
so Please have your pet spayed or neutered to protect your pet.
This
contract is valid for the original purchaser of the dog from Marquis Royal Court (Seller). If the dog is transferrred
to another owner then this contract is null and void, as Seller has no way of knowing how the dog is cared for or who the
puppy is placed with. Buyer also must return signed copy of this contract in order for it to be valid with in 7
days from acquiring said puppy.
Buyer understands and agrees that any puppy purchased should have Marquis
as the prefix to their registered name. You choose the name that you would like to call your puppy. Please
respect me and my breeding program by complying.
Because of the danger of exposure to outside diseases, Seller
reserves the right to refuse the return of any puppy/dog in order to protect the health of my dogs.
No other guarantees
or warranties (written or verbal) are expressed or implied.
I also agree that any litigation will be
held in Seller's county. Any litigation is between the Breeder/Seller and the Buyer.
This
written agreement is the entire agreement between seller/breeder and buyer of the animal concerning the health and condition
of the puppy purchased today. I understand and accept the terms and conditions as stated herein. Both Seller/Breeder
and Buyer are in agreement by their signatures below.
